    La articulación entre el SIDH y la Constitución peruana de 1993: reglas restrictivas del Nuevo Código Procesal Constitucional

    This text critically analyzes Peru’s new Constitutional Procedural Code in light of the standards of the Inter-American Human Rights System, particularly regarding effective judicial protection, due process, and the principle of conventionality control. Through a pluralistic dialogue among different doctrinal positions, it examines key reforms such as the transfer of jurisdiction over habeas corpus, the regulation of preliminary dismissals, the express omission of collective amparo proceedings, and the restrictions introduced on the use of Inter-American Court jurisprudence. The analysis highlights the tensions between the pursuit of procedural efficiency and the requirement to guarantee real, timely, and effective access to constitutional justice, in accordance with Articles 8 and 25 of the American Convention on Human Rights.

    La apelación sin agravio en los procesos constitucionales

    El propósito de esta investigación es analizar críticamente la postura adoptada por el Pleno Jurisdiccional Nacional Constitucional y Procesal Constitucional de 2023 en virtud de la cual se sugiere a los jueces resolver las apelaciones, aunque la parte procesal haya obviado exponer los agravios. Para tal efecto, se utilizará el método dogmático, que permitirá analizar el concepto de apelación, su finalidad, sus presupuestos y la naturaleza e importancia del agravio. Además, se empleará el método exegético, pues se dialogará con diversas jurisprudencias contradictorias sobre la exigibilidad del agravio; y, por último, a través del método comparado, se explorará la experiencia colombiana sobre la materia.
