Item type:Publication, «Brace yourselves! La videovigilancia ya viene»: situación de la videovigilancia en el ordenamiento jurídico peruano(Pontificia Universidad Católica del Perú. Fondo Editorial, 2019-11-29)This article seeks to analyze the legal bases of video surveillance, the state of the current unsystematic regulation in the Peruvian legal system and the first juridical-factual consequences that are emerging from its progressive application. In this way, the article begins with the study of the protection of the image of the person, with special attention to the phenomenon of video surveillance, from the point of view of Civil, Constitutional, Administrative and —even— Criminal law. Later, it studies the way in which the Legislator and —in other cases— the Executive have established the specific and particular rules on video surveillance in Peru at the national level. Finally, it continues with the description and analysis of some of the factual assumptions that have been challenging Peruvian authorities; among which we have the use of video surveillance as a method of monitoring by entities for security purposes, as a tool for the use of employers to detect labor infractions, as an obligation of the service providers to guarantee the security of the consumers, and as evidence of the correct conduct at the start and ending of a family visit’s regime when sons or daughters are taken out of regular home, this last is an example of the use of recorded video material of the private form or material of video surveillance as evidence in judicial and/or administrativeproceedings. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Las nuevas tecnologías y el daño al derecho a la autodeterminación informativa y derechos conexos: la IA como nueva amenaza a los derechos fundamentales(2024-02-15)El presente artículo académico tiene como finalidad exponer cómo las nuevas tecnologías, dándole énfasis a la inteligencia artificial, pueden resultar un peligro para los derechos fundamentales establecidos en la Constitución Política, con especial atención tanto al derecho a la autodeterminación informativa como a los derechos conexos al mencionado. Es así como luego de presentar diversas situaciones en las cuales la inteligencia artificial resulta una herramienta para vulnerar el derecho a la autodeterminación informativa como a los conexos de dicho derecho, se considera que sí existe un mecanismo para brindar una correcta tutela a dichos derechos, presente tanto en la norma suprema como en el Nuevo Código Procesal Constitucional, siendo este mecanismo el proceso constitucional de hábeas data. - Some of the metrics are blocked by yourconsent settings

A lo largo de este texto, me voy a referir al proceso de creación del fotolibro un cuerpo escupe sol (2023).Un libro hecho a mano, en formato acordeón, impreso en risografía, en donde utilizo la fotografía y el texto para explorar el espacio del sueño y del descanso como una vía de escape. Item type:Publication, Observación desde los umbrales(Pontificia Universidad Católica del Perú, 2023-10-16)This visual essay is based on Walter Benjamin’s critical analysis of the model of perceptual experience inaugurated by industrial culture, which influenced the observation and understanding of reality and the production of images of the avantgarde movements of the 20th century. In this way, the photographs selected have been recorded over several years with the aim of recovering the experience of observation from the thresholds, which are understood as interstices between the public and the private, between outside and inside, between the past and the present. The final objective of this essay is to recover a contemplative spectator that from a “middle” space, can represent the decline of urban spaces built thanks to the triumph of capital and the circulation of commodities.
