En este contexto, propone una tipologia de los plazos de prescripcion del procedimiento administrativo disciplinario de la Ley 30057, Ley del Servicio Civil, analizando los problemas que cada uno de ellos presenta; y esboza algunas propuestas de mejora normativa que permitan que estos plazos sean realmente garantistas tanto para los servidores imputados como para la Administracion Publica. EnglishThe present paper treats about the juridical nature of prescription in administrative sanctioning law and the treatment that it receives in the composition of administrative liability of civil servants. In this context, the paper proposes a typology of prescription period of the administrative disciplinary procedure of the Civil Service Law, analyzing the main issues that each of them present, and makes some proposals of normative improvement that allows these periods to be protective for accused servants and also for Public administration. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Assessing the Impact of Corporate Entrepreneurship in the Financial Performance of Subsidiaries of Colombian Business Groups: Under Environmental Dynamism Moderation(Research Square, 2020-10-26)Abstract Corporate entrepreneurship creates opportunities in employment, technological advances, value creation, and cultural transformation for entrepreneurial ecosystems, entrepreneurs, governments, economies and society around the globe. The purpose of this study is to assess the impact of corporate entrepreneurship on the financial performance of subsidiaries of Colombian business groups under the moderating effect of the environmental dynamism, because the relationship between corporate entrepreneurship and financial performance in emerging economies must differ from developed economies. Using a cross-sectional structural equation modeling analysis, this study assessed the impact of entrepreneurial orientation and corporate venturing on the firm financial performance of 87 subsidiaries of Colombian business groups at different levels of environmental dynamism. This study confirms that the relationship between corporate entrepreneurship and performance is context-dependent, and that entrepreneurial orientation has a strong and positive causal relationship to corporate venturing. Additionally, subsidiaries of Colombian business groups increase their financial performance when they increase entrepreneurial orientation and decrease financial performance when they increase corporate venturing. Furthermore, the results with and without environmental dynamism are similar. Item type:Publication, The evolutionary assembly of forest communities along environmental gradients: recent diversification or sorting of pre-adapted clades?(Cold Spring Harbor Laboratory, 2020-12-22)Summary Biogeographic events occurring in the deep past can contribute to the structure of modern ecological communities. However, little is known about how the emergence of environmental gradients shape the evolution of species that underlie community assembly. In this study, we address how the creation of novel environments lead to community assembly via two non-mutually exclusive processes: 1) the immigration and ecological sorting of pre-adapted clades (ISPC), and 2) recent adaptive diversification (RAD). We study these processes in the context of the elevational gradient created by the uplift of the Central Andes. We develop a novel approach and method based on the decomposition of species turnover into within- and among-clade components, where clades correspond to lineages that originated before mountain uplift. Effects of ISPC and RAD can be inferred from how components of turnover change with elevation. We test our approach using data from over 500 Andean forest plots. We found that species turnover between communities at different elevations is dominated by the replacement of clades that originated before the uplift of the Central Andes. Our results suggest that immigration and sorting of clades pre-adapted to montane habitats is the primary mechanism shaping communities across elevations.1 - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Peruvian regional cinema: Transtextuality, gender and violence in Bullying maldito, la historia de María Marimacha(Springer, 2020-12-17)This chapter analyses the connections between the Ayacuchean film Bullying maldito, la historia de María Marimacha [Damned Bullying, the Story of María Marimacha] (Mélinton Eusebio, 2015), American horror and B-series movies, and the Peruvian legend of María Marimacha. It also discusses the film's poster in relation to testimonies of sexual abuse suffered by women in Ayacucho during the Peruvian internal armed conflict. These transtextual connections reveal how the film and its poster together critique the heteropatriarchal norms and the fear of feminine agency held in Andean communities. They also speak to the wider context of the violence suffered by women in the region during the 1980s and 1990s. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, The challenges of wastewater reuse in Peru(Científica del Sur University, 2020-01-01)En el Per y, en particular, en la provincia de Lima se observa una situacin de mayor demanda hdrica y menor disponibilidad a causa de diversos factores, como son la distribucin asimtrica del recurso, el crecimiento demogrfico acelerado, los altos niveles de contaminacin de las aguas superficiales y subterrneas, entre otros, lo cual genera una situacin de escasez hdrica. Ante tal escenario, surge la imperiosa necesidad de implementar recursos alternativos a fin de generar una fuente adicional de suministro hdrico, que permita reducir la presin que se ejerce sobre las fuentes naturales y mejorar la calidad de los cuerpos receptores de agua, debido a la depuracin de las aguas residuales. En tal contexto, el presente artculo tiene por objeto dar alcances y propuestas frente a las siguientes interrogantes: cul es la solucin legislativa que se ha dado al problema de la contaminacin de las aguas en el pas, principalmente las aguas residuales de origen domstico sin depurar? y cul es la importancia de considerar a las aguas residuales tratadas como fuente de agua alternativa? En concreto, su finalidad estriba en el anlisis jurdico de la reutilizacin de las aguas residuales tratadas en el Per, a partir de una revisin del ordenamiento normativo que establece los aspectos tcnicos administrativos de su regulacin y gestin, en aras de mostrar su rgimen especial. Item type:Publication, The COVID-19 Pandemic and the Peruvian Catholic Church:(Universidad de Murcia, 2020-12-27)This paper examines the Peruvian Catholic Church's responses to the challenges of COVID-19, and how this context might constitute a new stage of the Peruvian Church’s reception of Vatican II. First, it values that the Catholic Church has performed a significant social contribution by distributing humanitarian aid, providing spiritual accompaniment, and articulating the civil society to face the needs raised by COVID-19. This paper argues that such response relates to the process of reception of Vatican II in Peru. During the 1970s and 1980s, the Peruvian Church developed pastoral structures and ecclesial networks that specialized in engaging with and serving the world. Nowadays, the Church offers those strengths to the State and society. Second, this paper examines how the pandemic presents opportunities for a new discernment of the "signs of the times" by highlighting some pastoral challenges the Peruvian Church needs to address in light of Peru’s new social reality and Pope Francis’ call for Church reform. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Digital inclusion across the Americas and the Caribbean(Cogitatio Press, 2020-01-01)This research brings together digital inequality scholars from across the Americas and Caribbean to examine efforts to tackle digital inequality in Uruguay, Chile, Peru, Brazil, Mexico, Cuba, Jamaica, the United States, and Canada. As the case studies show, governmental policy has an important role to play in reducing digital disparities, particularly for potential users in rural or remote areas, as well as populations with great economic disparities. We find that public policy can effectively reduce access gaps when it combines the trifecta of network, device, and skill provision, especially through educational institutions. We also note, that urban populations have benefitted from digital inclusion strategies to a greater degree. This underscores that, no matter the national context, rural-urban digital inequality (and often associated economic inequality) is resistant to change. Even when access is provided, potential users may not find it affordable, lack skills, and/or see no benefit in adoption. We see the greatest potential for future digital inclusion in two related approaches: 1) initiatives that connect with hard-to-reach, remote, and rural communities outside urban cores and 2) initiatives that learn from communities about how best to provide digital resources while respecting their diversely situated contexts, while meeting social, economic and political needs. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Perceived value as a mediating variable in the theory of planned behavior: Application to the intention of completing a Master of Business Administration(EconJournals, 2020-07-10)The objective of this research is to evaluate the intention to carry out an MBA in the Ecuadorian context through the model proposed by Azjen (1991); including the perceived value; as a mediating variable among the constructs (attitude, subjective norms and perceived behavioral control) and intention. The research was framed in a quantitative perspective, with a cross section. The estimation of the model was made, through the multivariate statistical technique of structural equations, in order to evaluate the relationships between constructs. The analyzed population were undergraduate students from all the Universities of Ecuador, of which a sample of 756 students was surveyed. It was evident that all the hypothetical relationships established in the proposed model are significant with respect to the intention to carry out an MBA. The perceived value for completing an MBA influences the intention to complete an MBA by 0.894. Likewise, the perceived value was evaluated as a mediating variable, concluding in accordance with what was proposed by Ato and Vallejo (2011), which meets the different processes for verification. Finally, the correlations between attitude, subjective norms and control perception were reported to be significant. In addition, the R2 of the dependent variables was determined, hence, the intention to carry out an MBA reported 79.9%; Similarly, the perceived value was determined, obtaining 65.5%.Keywords: Theory of Planned Behavior (TCP); Perceived value; MBA graduate studies; Structural equations.JEL Classifications: M14, M20, M30DOI: 10.32479/irmm.9866 - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Respuestas del Estado peruano frente al crimen organizado en el siglo XXI(Universidad Icesi, 2020-05-01)The fight against organized crime has become one of the priorities of the Peruvian State's criminal policy. As a result, the Peruvian government has approved different measures to control this phenomenon. The aim of this paper is to describe, from a theoretical and empirical approach, the overall picture of the manifestations of organized crime in Peru and the State's responses to control it. In this context, it is proposed to identify the existence, or not, of sufficient elements to configure an efficient general policy against organized crime. In order to do so, a legislation and records review was carried out, which allows to critically assess the progress and challenges of the State's responses to face and sustain a more efficient policy of control and fight against criminal organizations in Peru. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, What makes teams more innovative in small high-technology ventures? The role of leadership(Inderscience Publishers, 2020-01-01)Fostering team innovation has been considered as a major leadership function in high-technology ventures because they face intense competition in the market. In this research, we analysed the direct and indirect effects of transformational leadership on team innovation in small high technology ventures. A total of 24 team leaders and 133 employees from high tech industries in Iran participated in our study. Using structural equation modelling, we found that transformational leaders play a crucial role in enhancing team innovation, facilitating team trust and team communication quality. Nevertheless, transformational leadership was not related to team innovation directly. We also found that transformational leadership plays a facilitating role in improving trust and communication within a team. In the context of developing countries, this study provides empirical evidence of the prominent role of transformational leadership in encouraging team innovation by facilitating communication and trust among team members.
