    ¿Cómo enverdecer el derecho comunitario andino?: propuestas para insertar políticas de precios al carbono en un contexto de recuperación verde de la Comunidad Andina

    The global pandemic crisis has created a valuable opportunity to promote green recovery policies at the level of regional integration blocks that are tightly aligned to climate policies, including carbon pricing. The European Union’s Green Deal is an example. We propose that the Andean Community (CAN, by its acronym in Spanish) follows that example by establishing carbon pricing policies in its community law framework, adapting it to its level of regional integration and to the needs of its member countries. We suggest five ideas of carbon pricing policies that Andean countries could adopt within the CAN: phasing out of fossil fuel subsidies, regulating a border-adjustment carbon tax, creating a regional carbon tax, defining a reference social carbon price, and establishing a regional carbon market. To achieve them, the Andean Community can choose between establishing community legislation of uniformization or harmonization. We argue that harmonization is the best option because it would allow for setting a realistic and viable goal, freeing each member country to decide how to attain it.

    Indicadores comerciales de la Comunidad Andina 2002-2021: ¿Posible complementariedad o convergencia regional?

    La Comunidad Andina es uno de los procesos de integración pioneros en la región, y ha tenido diferentes fases de auge y crisis. En este trabajo se identificó la evolución de la relación bilateral de los países miembros en los últimos 20 años, a través de la elaboración de los principales indicadores de comercio. Con la construcción de esta evidencia empírica, se busca contribuir al esfuerzo de convergencia, el desarrollo de cadenas regionales productivas más diversificadas y con mayor valor agregado. Y, se fortalezca así la competitividad de la región, y se avance en la profundización de la integración regional.

    Déficit peruano, perfiles de comercio y bloques económicos regionales en los noventa

    Peru faces an increasing desequilibrium in its trade balance on the nineties, in spite of an expansion on its exports´ value. In part these deficits are presented with our commercial partners of the Andean Community and Mercosur.This paper presents a disaggregated analysis of the Peruvian trade with the Andean Community and Mercosur, trying to identify some peculiarities since in several years we had positive balances in the trade with other extra-regional blocks.Also, we present the sectors with a significant intraindustry trade, as often as the exports with more value added go toward Latin America. Finally, we have estimated indexes reflecting the comparative advantages of the trade which contribute to contrast the specialization pattern with the world and the one with the Andean Community and Mercosur.In short, we compare the trade patterns with the regional and extra-regional partners in an open economic context. This is an empirical approach which tries to identify difficulties that must be resolved to improve our insertion into the world economy.

    La historia sin fin del proceso de reingeniería de la Comunidad Andina: análisis de algunas propuestas de reforma

    En el presente artículo se analiza el proceso de reingeniería de la Comunidad Andina, incluyendo las consultorías formuladas por la CEPAL y la Fundación Getulio Vargas. Se examina el papel de Colombia durante su Presidencia Pro Tempore y se explican las implicancias de la tercera consultoría internacional en dicho proceso. En particular, se detallan algunas de las propuestas presentadas por el Tribunal Andino para la reforma del sistema de solución de controversias de la Comunidad Andina, tales como: el fortalecimiento de la función arbitral, el cobro de derechos de trámite por los servicios judiciales brindados y la constitución de un fideicomiso.
