Item type:Publication, ¿Cómo enverdecer el derecho comunitario andino?: propuestas para insertar políticas de precios al carbono en un contexto de recuperación verde de la Comunidad Andina(Pontificia Universidad Católica del Perú. Fondo Editorial, 2021-05-26)The global pandemic crisis has created a valuable opportunity to promote green recovery policies at the level of regional integration blocks that are tightly aligned to climate policies, including carbon pricing. The European Union’s Green Deal is an example. We propose that the Andean Community (CAN, by its acronym in Spanish) follows that example by establishing carbon pricing policies in its community law framework, adapting it to its level of regional integration and to the needs of its member countries. We suggest five ideas of carbon pricing policies that Andean countries could adopt within the CAN: phasing out of fossil fuel subsidies, regulating a border-adjustment carbon tax, creating a regional carbon tax, defining a reference social carbon price, and establishing a regional carbon market. To achieve them, the Andean Community can choose between establishing community legislation of uniformization or harmonization. We argue that harmonization is the best option because it would allow for setting a realistic and viable goal, freeing each member country to decide how to attain it. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, El proceso político de las iniciativas legislativas climáticas en el Perú: la tortuosa travesía de la Ley Marco sobre Cambio Climático (2008-2018)(Pontificia Universidad Católica del Perú. Instituto de Ciencias de la Naturaleza, Territorio y Energías Renovables (INTE-PUCP), 2022-05-25)This article seeks to contradict the assumption that environmental and climate issues are subordinated to the economic growth agenda in public policy and legislative decisions. On the contrary, it proposes that certain political conditions and extraordinary events might be coordinated in such a way as to successfully drive environmental and climate initiatives into public debate, which, far from being seen as residual issues that can be postponed without major political costs, eventually manage to overcome the hurdle of economic objections and ideological misgivings. To support this argument, we analyze the complex political process that Law 30754, Framework Law on Climate Change, has faced since even as early as 2008, with the first bills, until its approval in the Congress of the Republic in 2018 and its subsequent enactment by the Executive Branch. - Some of the metrics are blocked by yourconsent settings

En ellos se constata la importancia y necesidad de contar con información precisa, oportuna y continua que absorba el conocimiento local sobre el clima y la actividad agraria. Item type:Publication, Mujeres indígenas y cambio climático: reconociendo las prácticas ancestrales y sustentables de mujeres indígenas para la adaptación al cambio climático. Resumen ejecutivo(Instituto de Democracia y Derechos Humanos de la Pontificia Universidad Católica del Perú (IDEHPUCP), 2022-12)La Relatoría Especial sobre los derechos de pueblos indígenas de las Naciones Unidas ha indicado en el 2017, que son los pueblos quienes sufren las peores consecuencias del cambio climático debido a que sus formas de vida y prácticas de supervivencia están ligados a los ecosistemas en los que viven, por lo que reciben un mayor impacto frente a fenómenos meteorológicos extremos como las inundaciones, sequías y calor, situaciones que ponen en riesgo su misma existencia. Sin embargo, al desempeñar un papel fundamental en la conservación de la diversidad biológica y protección de recursos naturales, no deben ser vistos como víctimas del cambio climático, sino que, al contrario, son quienes contribuyen considerablemente para hacerle frente y ejemplifican la resiliencia al adoptar nuevas medidas de adaptación. En ese sentido, la Organización Nacional de Mujeres Indígenas Andinas y Amazónicas del Perú (ONAMIAP) y el Instituto de Democracia y Derechos Humanos de la Pontificia Universidad Católica del Perú (IDEHPUCP) han identificado la necesidad de realizar un diagnóstico situacional que reconozca las acciones adoptadas desde los pueblos indígenas frente al cambio climático, así como la manera de cómo se percibe y experimenta por un lado, la población masculina y, por otro lado, la femenina. De este modo, el estudio parte de las voces propias de las mujeres indígenas, entendiéndolas, desde su formulación, como protagonistas de sus propios destinos y a la vez agentes de cambio al interior de los pueblos indígenas al cual pertenecen. - Some of the metrics are blocked by yourconsent settings

Instituto de la Naturaleza, Tierra y Energía (INTE-PUCP), 2022)This article exposes and analyzes different actions in which the Armed Forces can participate taking advantage of what Kingdon (1984) calls «windows of opportunity», which will remain open for short periods and if they are not taken advantage of in the political process, the opportunity cost will be lost, and it will be necessary to wait for another one to appear again at a certain moment; all this with the purpose of strengthening the State’s capacity to benefit the population and of having a country on the path to sustainable development. The Armed Forces play a very important role in the State’s sustainability strategy, and they have managed to be considered as an insurance against future conflict scenarios related to climate change. They could participate in supporting society through a significant contribution to adaptation to climate change. Instituto de la Naturaleza, Tierra y Energía (INTE-PUCP), 2022)Faced with the urgent call to action raised in the latest IPCC report, this paper takes a panoramic review at the general problems of Peruvian cities tackling climate change, revealing that the challenge is twofold: to build resilience to climatic variability, but above all to overcome the structural causes that produce high levels of social and ecological vulnerability. It is concluded that the four dimensions of environmental justice -distribution, recognition, participation, capacities- allow a more complete analysis of the vulnerabilities to overcome and achieve fair resilience; also, progresses have been found in this regard. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Pandemia, Cambio Climático y el Perú(Pontificia Universidad Católica del Perú. Instituto de la Naturaleza, Tierra y Energía (INTE-PUCP), 2022)This article presents an analysis of the relationship between the pandemic and climate change, as well as an analysis of the impact of its effects in Peru. In this way, it contrasts the different international commitments assumed by Peru for the mitigation of climate change and the actions that have been taken to achieve these commitments. This brings to light the problems of governance and institutional strength, which have been evidenced, and in other cases aggravated, by the pandemic. To conclude, different legal perspectives on the General Law on Climate Change will be presented, in order to point out the challenges Peru faces in achieving effective legislation on climate change mitigation.
