    Razonamiento moral e identidad moral en abogados dedicados al arbitraje

    Arbitration offers a fast and effective way to resolve disputes between different entities. Arbitrators have the responsibility to solve these conflicts with justice and impartiality. Given the importance of this function, it is necessary to have professionals who have developed their moral capacities to the fullest extent. Unfortunately, various acts of corruption have cast doubt on the moral capacity of some arbitrators and have highlighted the need to investigate the moral development of this population. In this context, the present study aimed to describe and analyze the characteristics of moral reasoning and moral identity of a group of lawyers who devote a good part of their professional work to arbitration. Seventeen lawyers, men and women, who devote more than 50 % of their time to arbitration, participated in this study. The results indicate that, generally speaking, participants reason at a conventional level that makes them prioritize interpersonal expectations and the maintenance of the social system over moral principles. Additionally,the interviewees show different types of identities, some related to social or prosocial issues, but none strictly moral. The results are discussed emphasizing the consequences of low moral reasoning and poor moral identity development, and the need to rethink the moral education of students in law schools.

    El arbitraje inmobiliario en tiempos de pandemia en el derecho español

    La crisis sanitaria por el COVID ha sacudido con fuerza todos los países del mundo. En España se ha materializado en una situación de excepcionalidad constitucional que ha provocado importantes modificaciones jurídicas y ha afectado a todos los ámbitos jurídicos: civil, administrativo, tributario y procesal. No obstante, en ninguna normativa excepcional para estos casos se ha aludido al arbitraje, a pesar de su utilización en el ámbito inmobiliario. El COVID ha impactado también en el arbitraje y ha modificado la forma de realizar el procedimiento: personal trabajando desde casa; envío de comunicaciones telemáticamente; cancelación de audiencias; videoconferencia; etc. La continuidad del arbitraje, frente a los procedimientos judiciales, ha sido como consecuencia de la flexibilidad de que goza el arbitraje como mecanismo de resolución de conflictos privado, adaptándose el procedimiento a las necesidades de las partes. Los distintos organismos españoles dedicados al arbitraje así lo han ido haciendo si bien han chocado, en ocasiones, con la suspensión de los plazos procesales en los casos en que los tribunales españoles actúan como apoyo y control del arbitraje. El colapso judicial que se prevé, una vez terminado el estado de alarma en España, traerá un auge del arbitraje, por su rapidez.

    Arbitraje en las expropiaciones en el Perú

Se parte de un recuento de las distintas normas que han regulado la materia y se cuestiona algunos aspectos de la regulación actual. Asimismo, se analiza las características de este tipo de arbitraje y las materias arbitrables. Finalmente, el artículo brinda un panorama de cómo se han llevado a cabo en la práctica los arbitrajes en materia de expropiación desde 1999..

    Apuntes sobre el arbitraje en la nueva ley general de contrataciones públicas

    This article analyzes several arbitration provisions contained in the new General Law on Public Procurement – Law No. 32069, which, in the author’s view, are controversial, incomplete, or require further development for better understanding. In particular, it examines aspects related to procedural rules applicable to arbitration, substantive rules governing the merits of the case, judicialization of claims arising from the total or partial non-approval of additional services, continuity in the performance of contractual obligations, the statute of limitations in arbitration, the binding nature of the arbitral award, and the countersecurity required for interim measures.

    This research seeks to address the question of why arbitral tribunals have interpreted treaties concluded by the United States as taking a pragmatic approach to the invocation of the denial of benefits clauses they contain. Thus, our hypothesis states that various of the arbitral tribunals that have interpreted these treaties adopting a pragmatic approach have interpreted these clauses following various methods of interpretation, among which (i) the literal method, (ii) the teleological method, and (iii) the functional method of interpretation are predominant. In this sense, the main objective of the research will be to identify the main grounds used by the arbitral tribunals when analyzing the moment of invocation of these clauses in this type of treaties. To this end, the methodology used is qualitative in nature and seeks to be mainly analytical of existing jurisprudence. The aim is to directly analyze the decisions of existing arbitration cases and, indirectly, the bibliographical sources that analyze the decisions of this case law.

    ¡Atención árbitros, las cosas están cambiando en el sector construcción!: Building Information Modelling (BIM) como prueba en el arbitraje

    Building Information Modelling (BIM) is essential for orderly project management. Linked to international standardized construction contracts such as NEC (New Engineering Contracts), it contributes to the reduction of execution times and project cost savings, which, in public works, translates into a more efficient management of government resources. By concentrating information that is provided contemporaneously by all parties involved, it will contribute to generate in the arbitrators the conviction they require with a view to reaching material truth, thus contributing to a more solid motivation of the awards. This poses the challenge for arbitrators to become more skilled in the technical and technological aspects of construction disputes, in general, and in the technical evaluation of evidence, in particular.
