    The jurisprudential evolution of the Court of Justice of the Andean Community in the field of the trade name

    La presente investigación tiene por objetivo el estudio de la evolución jurisprudencial del Tribunal de Justicia de la Comunidad Andina (TJCA) en relación con el ámbito de protección territorial del nombre comercial: desde la jurisprudencia primigenia de la década de 1990 hasta la jurisprudencia actual, la cual retorna a la posición inicial del TJCA. Actualmente, la jurisprudencia andina precisa que la protección del nombre comercial (no registrado) debe tomar en cuenta “la amplitud de las operaciones” y el “ámbito geográfico” de su uso (Procesos 42-IP-2017 y 317-IP-2017). La metodología de investigación utilizada incluye los aspectos normativo, jurisprudencial y doctrinal, lo cual apoya la decisión del TJCA de modificar la posición —equivocada, por cierto— que se había establecido en el Proceso 99-IP-2014 (“el nombre comercial debe ser protegido en todo el territorio nacional”).

    Regional integration agreements and higher education in the Andean countries

    The promotion of higher education has been a common denominator in the integration processes in the region, however, the results achieved have been heterogeneous. The main characteristics and limitations are pointed out. It also reviews the commitments assumed in Peru's main North-South and South-South trade agreements. The need to deepen these commitments and liberalization in regional integration agreements is discussed.

    La historia sin fin del proceso de reingeniería de la Comunidad Andina: análisis de algunas propuestas de reforma

    En el presente artículo se analiza el proceso de reingeniería de la Comunidad Andina, incluyendo las consultorías formuladas por la CEPAL y la Fundación Getulio Vargas. Se examina el papel de Colombia durante su Presidencia Pro Tempore y se explican las implicancias de la tercera consultoría internacional en dicho proceso. En particular, se detallan algunas de las propuestas presentadas por el Tribunal Andino para la reforma del sistema de solución de controversias de la Comunidad Andina, tales como: el fortalecimiento de la función arbitral, el cobro de derechos de trámite por los servicios judiciales brindados y la constitución de un fideicomiso.

    The Complex Regional Governance of Latin American E-Commerce: A Comparative Perspective on the Pacific Alliance, the Andean Community, and Mercosur

    Objective/context: The proliferation in the number, depth, and scope of e-commerce agreements has integrated shared agendas and memberships within Latin America's complex regional governance, making cooperation and fragmentation non-exclusive practices. Therefore, this article asks about the conditions that have facilitated or limited the development of a Latin American digital market. Methodology: A comparative qualitative analysis of the Pacific Alliance, the Andean Community, and Mercosur, together with process tracing, will shed light on their progress in this area, taking into account the degree of linkage they maintain with three mechanisms that foster collaboration and coordination dynamics among various institutions an d actors. Conclusions: The analysis shows that, within systems characterized by growing institutional density and diversity— such as the Latin American e-commerce environment—regional cooperation can be facilitated when regional trade agreements are embedded in a broader trade regime, where there is a clear sequencing among different agreements, and when orchestrators and policy networks are present. In contrast, their absence leads to ineffective agreement implementation and increased regional fragmentation. Originality: This work connects studies on complex regional governance with a relatively underexplored agenda in Latin American academic literature: e-commerce.
