    El objetivo del presente artículo es analizar si el derecho es, efectivamente, un tipo de conocimiento que se debería presumir que es o no conocido por todos. A partir de una revisión de diversos autores y normas, se identifican las barreras lingüísticas contra la posibilidad de un acceso efectivo a los diversos tipos de normativa nacional e internacional. Finalmente, se proponen algunas soluciones a la problemática expuesta.

    Mesa redonda: ¿Derecho administrativo económico, regulación o derecho regulatorio?

    This roundtable examines one of the central debates in contemporary public law: the relationship between economic administrative law, regulation, and the possible existence of a “regulatory law” as an autonomous branch. One position maintains that no such conceptual distinction exists, as regulation is a multidisciplinary phenomenon whose legal application is carried out through the proper techniques to administrative law. In contrast, another view offers a more nuanced interpretation. It distinguishes between economic administrative law as a legal discipline, and regulation as a specific technique of intervention applied to strategic sectors or those with structural failures. Based on this distinction, it is argued that although regulation is rooted in public law, it exhibits certain modulations that warrant independent consideration. The debate, without doubt, offers the reader a rich confrontation of ideas.

    La política de asignación directa de espectro 5G en el Perú: ¿recuperar el tiempo perdido o fracasar en el intento?

    The trajectory of 5G in Peru reveals a significant delay. In this article, the autor reviews the regulatory evolution from the initial trials to direct spectrum allocation mechanism, highlighting its role in expediting the deployment of advanced networks. The analysis of policies, obstacles, and essential conditions –investments, spectrum reordering, and regulatory commitments– concludes that 5G’s success hinges on decisions that secure contiguous spectrum and drive digital transformation.

    Apuntes sobre el arbitraje en la nueva ley general de contrataciones públicas

    This article analyzes several arbitration provisions contained in the new General Law on Public Procurement – Law No. 32069, which, in the author’s view, are controversial, incomplete, or require further development for better understanding. In particular, it examines aspects related to procedural rules applicable to arbitration, substantive rules governing the merits of the case, judicialization of claims arising from the total or partial non-approval of additional services, continuity in the performance of contractual obligations, the statute of limitations in arbitration, the binding nature of the arbitral award, and the countersecurity required for interim measures.
