Centro de Investigación, Capacitación y Asesoría Jurídica, 2022)La emergencia sanitaria generada por el virus SARS-CoV2 ha tenido consecuencias de gran magnitud en diversos ámbitos de la vida cotidiana, entre ellos el jurídico. Las relaciones contractuales de índole comercial se vieron alteradas por la pandemia, provocando diversos conflictos entre las partes contratantes por el incumplimiento de obligaciones, principalmente aquellas que por disposición de la autoridad sanitaria suspendieron sus actividades para evitar la propagación del virus. En este artículo se analiza la causa de fuerza mayor en el incumplimiento de contratos de arrendamiento de inmuebles destinados a fines comerciales en el Estado de Nuevo León, México. Se hace un análisis del contrato de arrendamiento, de la fuerza mayor, sus causas, presupuestos de aplicación, efectos entre los contratantes, así como de los puntos que seguramente serán puestos a consideración de los tribunales en las controversias que se lleguen a suscitar por este problema, todo ello en un marco legal, doctrinal y jurisprudencial. - Some of the metrics are blocked by yourconsent settings

Instituto de la Naturaleza, Tierra y Energía (INTE-PUCP), 2022)This article presents an analysis of the relationship between the pandemic and climate change, as well as an analysis of the impact of its effects in Peru. In this way, it contrasts the different international commitments assumed by Peru for the mitigation of climate change and the actions that have been taken to achieve these commitments. This brings to light the problems of governance and institutional strength, which have been evidenced, and in other cases aggravated, by the pandemic. To conclude, different legal perspectives on the General Law on Climate Change will be presented, in order to point out the challenges Peru faces in achieving effective legislation on climate change mitigation. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Challenges for higher education in Peru during the COVID-19 pandemic(Universidad Cientifica del Sur, 2021-08-30)This essay describes and reflects on the experience of higher education in the context of the public health emergency resulting from COVID-19 and declared from March 2020 to the present. The closure of university settings has created considerable challenges for students and teachers nationwide. In this context, virtual education was implemented, in order to reduce infections and also to ensure the continuity of studies for young people. Virtual education brought about changes, most of which were forced and unplanned; however, they have also constituted an opportunity for the implementation of learning platforms and technologies. Based on a review and analysis of the scientific literature, this paper discusses the implications for students and teachers of this new virtual education scenario in Peru. - Some of the metrics are blocked by yourconsent settings

Item type:Publication, Resiliencia y memorias en Perú durante la pandemia(Pontificia Universidad Católica del Perú, 2022-12-12)Peru is one of the countries most affected by the Covid-19 pandemic, where the health crisis quickly provoked a serious socio-economic and political crisis. The fragile Peruvian state was unable to build an effective response to this multifaceted crisis, in this context, we defend the hypothesis that forms of affectivity, solidarity, memory and collective resilience related to the recent past (1980-1990) were reactivated in many rural and urban communities of the country. Based on a qualitative methodology, this article questions the role that the collective memory played in reactivating historical forms of community resilience at the local level. Based on three empirical cases (the rondas campesinas, the Covid commandos and the ollas comunes), we analyze how the memories of past violence and crises, as well as the responses to them, have offered original tools in certain communities to elaborate effective responses of resilience during the first months of the global pandemic. In this sense, we reflect and draw attention to the potential of setting up agency and resilience based on collective memory, which is framed is by the diversity of the cultural and local experiences. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Border closure and COVID-19: Impact on the lodging and restaurant business in Tacna (Perú)(Universidad de Tarapaca, 2024-01-01)The COVID-19 pandemic caused the stoppage of the movement of people globally, a situation that especially affected tourism as an economic activity. This article addresses the impact of the closure of the Peruvian-Chilean border during the COVID-19 pandemic on the hotel and gastronomic sector of Tacna. Through a qualitative methodology that included a bibliographic review, economic data analysis, and semi-structured interviews with hotel and restaurant owners and managers, we investigated the problems they had to face during the pandemic and the strategies to overcome them. The findings indicate that until March 2020 both items experienced strong growth within the framework of cross-border practices from Chileans to Tacna, within which enjoying Peruvian food was one of the main attractions. The pandemic forced small hotels and restaurants to deploy strategies such as layoffs and the provision of family labor to overcome the crisis and convert to delivery food. The largest and most formalized companies accessed subsidies and support from the state and in other cases, the reconversion was hand in hand with agreements with mining companies to house workers while the health emergency lasted. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Efectos de la pandemia y las medidas de confinamiento sobre la salud mental en población infantil de Chile(Pontificia Universidad Católica de Chile, 2023-07-03)The COVID-19 pandemic has evolved complex challenges especially for families with children and adolescents. The impact of the pandemics' confinement on mental health has been described as devastating, limiting the resources available to families and increasing caregivers' stress levels and demands on their efforts. This study showed the results of an online survey of caregivers, mothers or fathers, with at least one child between 0 and 11 years old who lived the first weeks of confinement throughout Chile. The variables associated with physical symptoms, anxiety, mood, disruptive behavior, sleep problems, low frustration tolerance, attentional difficulties, hyperactivity and regressive behaviors that are related to the psychological impact that the measure of confinement has had on children from 0 to 11 years of age were studied through a questionnaire quantifying their frequency by age group, identifying how these effects are expressed in relation to the vital stages of child development. The results indicate that the younger the age of the children (0 to 3 years) the greater the presence of disruptive behaviors, while the older the age (9 to 11 years) the greater the presence of symptoms such as sadness, anxiety, listlessness and sleep problems. The implications of these results are discussed in terms of policies and strategies to address them, which should consider both the developmental stage of the children and the main caregivers, given the protective role they can play in stressful situations. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Curricular policy response to an educational crisis in Peru and Chile: Reflections after the COVID-19 pandemic(Arizona State University, 2025-01-01)Durante la crisis sanitaria de los años 2020 y 2021, los sistemas educativos generaron múltiples formas de enfrentar el cierre de las escuelas. En el caso de Perú y Chile, las políticas educativas relativas al currículum siguieron la lógica de la reducción de la prescripción y el levantamiento de dispositivos diversificados para resguardar la continuidad de la formación. En dicho contexto, este estudio permitió conocer los propósitos, criterios y procesos decisionales que caracterizaron las acciones asumidas a nivel macro. Para ello se desarrolló un estudio de casos instrumental múltiple, considerando ambos países. Por medio de un análisis documental y entrevistas individuales y grupales a las personas que tomaron las decisiones de política en el periodo mencionado, se pudo comprender, en primer lugar, que los propósitos y criterios dan cuenta de una dicotomía entre prescribir y orientar a las escuelas, pues los espacios de flexibilidad que se abrieron eran inéditos. En segundo lugar, los procesos decisionales estuvieron marcados por la adaptación rápida y un trabajo más sinérgico al interior de los ministerios respectivos. Finalmente, la respuesta curricular en ambos casos generó, por una parte, más instancias de empoderamiento docente y, por otra, cierto grado de desconfianza e incomprensión en el profesorado.1
