Item type:Publication, Investigación académica sobre el consumidor vulnerable: parámetros sobre su necesaria institucionalización en el ordenamiento jurídico peruano(Military University Nueva Granada, 2024-05-06)En los últimos tiempos se ha discutido la categoría del consumidor vulnerable en Latinoamérica, lo que determina una fuerte raigambre humanista y tutelar sobre la protección al consumidor; sin embargo, en el Perú no se ha observado esta figura con nitidez teórica y práctica, pese a los diversos casos jurisprudenciales. En este sentido, el objetivo principal de esta investigación es determinar el statu quo de la legislación sobre el consumidor vulnerable en el Perú, lo que permitió proponer y construir las bases normativas para su positivización en nuestro ordenamiento jurídico. La justificación se entiende desde una triple perspectiva: teórica, en tanto permite proponer esquemas doctrinarios; práctica, porque su materialización involucra una serie de cambios en los instrumentos de gestión por parte de la autoridad administrativa, así como nuevas políticas empresariales; y de trascendencia social, toda vez que permite reconocer y garantizar derechos de protección al consumidor. El tipo de investigación fue de carácter cualitativo, de nivel descriptivo con diseño prospectivo, en tanto se buscó conceptualizar al consumidor vulnerable y, al mismo tiempo, se utilizaron instrumentos y técnicas de recolección y procesamiento de datos que permitieron validar la propuesta investigativa desde un plano social. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Street Workers and the Law: A First Impression on Legalized Discrimination in Municipal Ordinances on the Matter in Metropolitan Lima(Onati International Institute for the Sociology of Law, 2023-10-03)Street trade is one of the most common sources of income for people living in poverty in mostly informal economies. Such work exposes them to a series of economic, social and also legal barriers. In the present document, we have analyzed the legal provisions of eight districts of Metropolitan Lima to determine how the norms regulate the work, the use of space, hygiene and the time of street traders in this city. According to our research, the municipal ordinances of Metropolitan Lima point to the street trader as another racialized person who must be controlled in the public space. Although it is not excluded, its inclusion is precarizing, increasing its vulnerability. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, El lugar de la mujer: La segregación ocupacional horizontal por razón de género en el mercado laboral peruano(Pontificia Universidad Católica del Perú, 2023-11-22)This essay delves into the persistent problem of occupational gender segregation in the labor market and its impact on equal opportunities. Despite the increase in female participation in the workforce in recent decades, labor inequalities remain a reality that poses significant challenges to achieving gender equity in the workplace. In the Peruvian context, a marked occupational segregation is evident: women predominate in sectors such as services and commerce, while men mostly occupy “masculinized” positions in the formal private sector. The methodology used combines an exhaustive review of the literature from economic and gender perspectives with the analysis of official statistics and scientific publications. The bibliographic review is carried out from a multidisciplinary approach, which combines economic and gender elements, allowing a comprehensive analysis of occupational segregation based on gender. The collection and processing of relevant quantitative information on occupational segregation in the Peruvian context provides a solid basis for understanding the current situation and trends in the Peruvian labor market in relation to gender segregation. In this way, it seeks to make visible the pre-existing dimensions that define the place of women in the Peruvian labor market. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, “Not All Old Age Is the Same”: Human Rights of Older Women and the Importance of the Gender Perspective(Universidad Externado de Colombia, 2023-05-01)The progressive incorporation of the gender approach to International Human Rights Law has allowed the recognition of the human rights of women and the identification of particular effects, such as sexual violence or femicide. Now, an intersectional approach is important to identify the diversity among women and recognize the situations that they go through due to certain conditions, such as, for example, age. The article focuses on the analysis and recognition of the human rights of older women, highlighting the continuity of gender violence and discrimination that begins in childhood and determines the reality of women when they reach old age, emphasizing in cases of sexual violence, forced motherhood, the role of care assumed by older women as well as their contribution to the search for justice in cases of forced disappearance.
