    Incommensurable worlds, irreparable wounds: Transitional justice politics and personal violent pasts in postconflict Peru

    Reparation programmes in transitional justice processes imply that there are ways to repair social bonds, to dignify victims of violence, to reconstitute what is lost. But how does losing a relative translate into the twists and turns of a state social programme? Based on ethnographic research in the Peruvian Andes and the life history of a daughter of a Shining Path leader, this article explores the ways in which transitional justice discourses get translated into specific national reparation policies embedded in a series of mnemonic wars. These mnemonic wars imply different levels of confrontation, and invisibilization of subjects and citizenships.

    Punishment and pardon: the use of international humanitarian law by the Special Jurisdiction for Peace in Colombia

    Transitional justice systems generally aim to achieve two goals. One is to bring the perpetrators of past atrocities to justice to ensure that they do not go unpunished, which involves the State fulfilling its duty to investigate, prosecute and punish serious human rights violations and breaches of international humanitarian law (IHL). The other is to bring about reconciliation to heal a divided society and achieve peace and stability. This normally requires the adoption of measures of clemency, such as granting amnesty, so that those who took part in the country's violent past can return to civilian life. The use of IHL is relevant in attaining both these goals because its complex nature means that it provides the legal basis for their implementation. However, this very complexity can mean that there are contradictions or complementarities between its characteristics. This article looks at the case of the Special Jurisdiction for Peace (JEP) in Colombia, showing how this transitional jurisdiction has used IHL as a legal basis both for investigating, prosecuting and punishing serious violations committed during the Colombian armed conflict and for granting amnesty to those who took part in the hostilities. These different uses by the JEP demonstrate that IHL is a flexible tool that can facilitate the process of delivering both justice and peace after a conflict has ended.

    ¿Manos limpias y corazón puro?: La aplicación de la doctrina de manos limpias por parte de la Corte Interamericana de Derechos Humanos

    Este artículo realiza un análisis de la práctica de la Corte Interamericana de Derechos Humanos (CorteIDH) respecto de la doctrina de “manos limpias” y su legitimidad. El texto argumenta que un enfoque de “manos limpias” para la compensación de daños morales en casos de derechos humanos es inadmisible. Su uso es aún más cuestionable, toda vez que la CorteIDH no ha brindado una explicación respecto de sus decisiones de negar reparaciones por daños morales solo para algunos infractores. El texto revisará casos en los que la CorteIDH ha otorgado y no ha otorgado una compensación monetaria por daños morales con el fin de resaltar su inconsistente jurisprudencia, así como la falta de criterios claros y decisivos. Se concluirá que la CorteIDH ha aplicado la doctrina de “manos limpias” sin manifestarlo explícitamente, y que esto no es compatible con el derecho internacional de los derechos humanos.

    Voces en el silencio

    This paper explores the effects of hospitality rites and the co-creation of common spaces as a means to achieve transitional justice in Peru, 20 years after the 1980–⁠2000 internal armed conflict. It describes a tea ceremony in La Hoyada, a place used by the Army as a clandestine burial ground. A foreign act of hospitality breaks the temporality of the site; mindful actions create silence, and the voices of people are better heard. This work describes the development of an incipient methodology, an intimate language of presence, and how video recordings of participants’ testimonies captured the feelings arising in a one-time silent event.

    Reflections on Silence and Ritualised Hospitality

    This essay explores a hospitality rite as a contribution to transitional justice. It describes a tea ceremony (and a related video recording, focused on testimonies) in La Hoyada, a site used as a clandestine burial ground for people abducted, tortured, and killed during the internal armed conflict in Peru. A place of destruction acquires new significance as an unfamiliar ritual breaks the temporality of the site; mindful hospitality actions create silence, so the voices of people can be better heard.     Efectos psicosociales de la Comisión de la Verdad en Brasil

    A Truth Commission (TC) was carried out in Brazil (2012-2014) to investigate human rights violations perpetrated by state agents, especially during the military dictatorship (1964-1985). TCs are supposed to help societies on the reconstruction of social cohesion after authoritarian or violent periods. We conducted three studies with undergraduate students and adult samples between 2014 and 2017. Evaluating the TC as effective was related to higher punctuations on the variables of social cohesion, even controlling the effects of political positioning. The TC effectiveness perception was associated with the emotional reaction (both, negative or positive) and a positive attitude towards remembering the past. Nonetheless, we found some different results across the three studies. These differences are discussed.
