    How the European Citizens’ Initiative ‘Water and Sanitation is a Human Right!’ Changed EU Discourse on Water Services Provision

    In 2010 the United Nations General Assembly recognized the human right to water and sanitation in what is seen as a historical vote by water activists. Implementation of the right to water is imperative to achieve sustainable development. In 2011 the regulation for a European Citizens’ Initiative (ECI) entered into force in the European Union. With such an initiative it is possible to propose an issue for European legislation by collecting one million signatures from citizens in at least seven Member States. The European federation of trade unions in the public services sector (EPSU) decided to take up the challenge to organise such an ECI and formed a diverse coalition of organisations and water activists that became known as ‘Right2Water.’ Their proposal was ‘to implement the human right to water and sanitation in European law.’ Although it was successful in achieving the required number of supporters, the European Commission answered that implementation of the human right to water was to be left to Member States and that there was no need to change existing legislation. The Right2Water movement aimed not as much to change legislation but more to challenge EU neoliberal policies and shift them from a ‘market approach’ to a ‘rights-based approach.’ This chapter looks at the factors that contributed to the success of ‘Right2Water,’ how the ideological debate around the human right to water took place during the campaign and the impact it had on EU discourse as well as on EU water policy.

    The renunciation of perimeter area as a means of sanitation of the area, boundaries, and perimeter measurements of urban properties

    En el presente artículo se efectúa un análisis a la regulación, la operatividad y la eficiencia del procedimiento registral de «renuncia de área» como medio de saneamiento incorporado a través del Pleno CIX del Tribunal Registral de la Superintendencia Nacional de los Registros Públicos. Se destacan aspectos doctrinales y jurisprudenciales en torno a su reglamentación y utilidad práctica, con la finalidad de evaluar su funcionalidad y la posible necesidad de mejoras normativas. Previamente, para lograr un mejor entendimiento del tema planteado, enunciaremos los aspectos más relevantes de los demás procedimientos de saneamiento de áreas, linderos y medidas perimétricas que, en vía judicial, notarial y registral, son aplicables a los predios urbanos.

    Collective infrastructures of care: Ollas comunes defying food insecurity during the COVID-19 pandemic

    The COVID-19 pandemic highlighted the importance of solidarity and care networks in withstanding crises. One example is the emergence of Ollas Comunes (Common Pots, a type of community kitchen) in the peripheries of Lima, which highlighted the enormous need for spaces that promote, channel, and strengthen collective support. Consolidating these networks, and allowing them to prosper over time, constitutes an alternative aimed at improving the living conditions of marginal groups, a crucial task in reducing urban inequalities. Co-production occurred at multiple scales: from local implementations of community kitchens to the design of urban networks for agriculture, water and sanitation, and food production. Collective innovation happened in technical terms towards promoting the efficient use of renewable resources (extending the concept of care to the care of the territory and the environment) and in the formulation of alternative governance in the maintenance and repair of the implemented infrastructure towards a renewed sense of citizenship.

    A qualitative study on resource barriers facing scaled container-based sanitation service chains

    Container-based sanitation (CBS) is an increasingly recognised form of off-grid sanitation provision appropriate for impoverished urban environments. To ensure a safely managed and sustainable service, a managing organisation must implement a service chain that performs robustly and cost-effectively, even with an expanding customer base. These ‘CBS operators’ adopt varying approaches to achieve this objective. Following research including interviews with representatives from six current CBS operators, this paper presents a generalised diagrammatic model of a CBS service chain and discusses the three broad thematic challenges currently faced by these organisations. Supplying cover material is a universal problem with hidden challenges when taking advantage of freely available resources. There is no universally applicable approach for the efficient collection of faecal waste despite the high labour costs of waste collection. The best strategy depends on the CBS operator's overall expansion strategy and the location of fixed features within the served community. Although CBS is technically well-suited to being turned into new products within the circular economy, in practice, this requires a diverse range of skills from CBS operators and is hampered by slow growth in other organic waste recovery services and unhelpful regulation.

    La supervisión ambiental en el sector saneamiento en el Perú: el caso de Ucayali

    El Perú, al igual que en diversos países de la región, es rico en recursos naturales, pero no obstante ello, su conservación se ve afectada por las diversas actividades económicas tales como la minería, la agricultura, la industria, la forestal y el saneamiento. Es esta última, la que es considerada como unos de los principales problemas ambientales que afecta a todo el país y en especial en los sectores ecosistemas frágiles como la selva peruana –como la región de Ucayali– o las fuentes de recursos hídricos, debido a una falta de control y vigilancia por parte de la entidad competente, es decir, por el Ministerio de Vivienda, Construcción y Saneamiento. Efectivamente, a pesar de la continua actuación del ministerio referido en el párrafo precedente, los problemas ambientales persisten y en algunos casos se han agravado, lo que se evidencia en los informes elaborados por la Organismo de Evaluación y Fiscalización Ambiental, ente rector del Sistema Nacional de Evaluación y Fiscalización Ambiental. Es así como, dentro de los problemas identificados que afectan a la adecuada fiscalización ambiental por parte de la entidad competente, tenemos a la incorrecta planificación ambiental que impacta negativamente en los resultados planteados por la entidad lo que impide la contribución o solución de los diversos problemas ambientales.Es así que el presente trabajo, luego de analizar el Sistema de Saneamiento y el Sistema Nacional de Evaluación y Fiscalización Ambiental, pretende identificar el problema que decanta en insuficiente e inadecuada fiscalización ambiental a cargo del Ministerio de Vivienda, Construcción y Saneamiento, proponiendo una solución que permita mejorar sus labores como entidad fiscalizadora.

    Does container-based sanitation align with sanitation sectoral planning in Lima?

    The paper explores the potential of Container-Based Sanitation (CBS) as an off-grid sanitation option in addressing extreme sanitation inequalities in informal urban settlements in Lima, Perú. It achieves this by evaluating the conflicting and political tensions within the formal and informal structures of state public service provision in Lima using qualitative data collected through semi-structured interviews with government officials, third-sector organizations, citizens of informal urban settlements, and academia. The paper argues that although the CBS provision has high social acceptability among its users within Lima's informal settlements, the state of Lima's fragmented sanitation sector regime hinders the possibility of scaling sanitation innovations. In Lima, scaling up CBS among informal settlements remains challenging as conventional sewerage is prioritised in WASH policy discourse and implementation. Even for CBS users, the technology was seen as a stopgap solution until they finally access sewered sanitation provided by the state, mainly because of the state's inability to fully address wastewater challenges and the assumption that conventional sewerage will eventually arrive.

    Born to die: lessons for the public sector from the failed water concession in Tumbes, Peru

    While Latin America has witnessed mixed results in public–private partnerships, understanding the factors driving these varied outcomes requires closer examination. Public institutions are responsible for the design, procurement, and regulation of contracts, yet the focus tends to be almost entirely on the private operator. This paper provides an in-depth case study of the water concession in Tumbes, Peru, which was prematurely terminated in 2018. The examination of the quantitative and qualitative information on contract design, the regulatory framework, and performance indicators reveals that well-designed contracts, strong institutions, and a solid regulatory framework are crucial for successful private participation.
