    El Estado, el diálogo y la transformación de los conflictos socioambientales

    This article discusses the necessary linkages that must exist between the State and the dialogue. To propose that the State is the space for dialogue par excellence, the text relies on the ethical nature that is inherent in the constitution of the State. Furthermore, the State represents a strategic and forward-looking perspective for human life in the world that is expressed and founded on such important issues as equality, recognition and democracy. This reflection about the State aims to reposition the role of the State in the face of its actual difficulties and limitations at becoming a true space for dialogue. The article reviews the characteristics that any dialogue must have taking into account the characteristics of conflicts, and especially socio-environmental ones, and their transformation process. It insists on the role of openness, open communication and permanent negotiation that the State must play to face the challenges posed by society and the environment. Finally, the article seeks to review ideas and concepts related to dialogue, redefine criteria and raise the need to build capacities and public policies to adequately face the challenges and conflicts that may arise.

    The Socratic ethos and the formation of being in legal education

    En la presente investigación presentamos características del ethos socrático a la luz de los últimos trabajos de Michel Foucault y Hanna Arendt, así como de nuestra lectura de los diálogos socráticos y lo sostenido por otros autores acerca de Sócrates. A partir de dicho trabajo, buscamos plantear cómo entender la dimensión del ser del estudiante universitario. Asimismo, nos preguntamos por el potencial que nuestra aproximación para promover el trabajo pedagógico en torno al ser del estudiante de derecho. Nuestra propuesta se centra en encontrar espacios en los que se puedan promover diálogos en los que los y las estudiantes revelen la verdad de sus propios pensamientos, así como de los modos de vivir asociados a ellos, con miras a ocuparse de sí mismos. Un punto central de la propuesta radica en comprender que los y las estudiantes de derecho tienen una serie de vivencias en sistemas regulatorios previos a su formación jurídica, como el de la familia o la escuela. Dichas vivencias marcan concepciones y modos de vivir en sistemas regulatorios que influirán en su comprensión y vivencia del derecho. Así, el ethos socrático sería un camino para trabajar en torno a dichas concepciones a fin de que los y las estudiantes las examinen en el marco de diálogos guiados por la humildad, el coraje, la congruencia y la pasión por la interrogación.

    Ethics position and leadership style in a mayor's office

    Recent cases of unethical behavior in organizations indicate the need to carry out empirical research about it. Determine the existence of a relationship between ethics and leadership, demanded by society and prescribed by various academic theories. Method: For this reason, through the conduction of non-experimental, cross-sectional, quantitative research, it is sought to make a process of falsification of the theoretical proposals in the context of a municipal mayoralty. In the development of the research, the responses of 219 leaders were satisfactorily received, answering questions from two psychometric instruments of wide recognition and academic validity, the Ethics Position Questionnaire and the Multifactor Leadership Questionnaire. They were carried out both through an exploratory data analysis and a confirmatory factor analysis, and a model of structural equations that tested the existence of a relation between the ethical position and the styles of leadership. Results: It was also possible to identify the influence exerted by the different ethical positions in each one of the styles of leadership in a local public administration. Conclusions: These findings facilitate the identification of ethical leadership models in local public organizations and contribute towards the empirical demonstration of the current discussion on the relationship between ethics and leadership in organizations.

    Governance frameworks for COVID-19 research ethics review and oversight in Latin America: an exploratory study

    Research has been an essential part of the COVID-19 pandemic response, including in Latin American (LA) countries. However, implementing research in emergency settings poses the challenge of producing valuable knowledge rapidly while upholding research ethical standards. Research ethics committees (RECs) therefore must conduct timely and rigorous ethics reviews and oversight of COVID-19 research. In the LA region, there is limited knowledge on how countries have responded to this need. To address this gap, the objective of our project is to explore if LA countries developed policies to streamline ethics review and oversight of research in response to the pandemic while ensuring its adherence to ethical standards, and to analyze to what extent these governance frameworks are in accordance with international guidance. Methods: We conducted a descriptive and exploratory study assessing the COVID-19 research ethics governance frameworks of 19 LA countries, considering 4 dimensions based on international COVID-19 ethics guidance documents: (i) ethics review organizational model adopted, (ii) measures to coordinate between RECs and other research stakeholders, (iii) operational guidance for RECs, and (iv) key ethical issues for review and oversight of COVID-19 research. Results: 10 out of 19 LA countries have some policy to streamline ethics review of COVID-19 research. Of these countries only 6 issued comprehensive documents following international guidance that contemplate strategies with recommendations for concrete actions for a timely and rigorous review. Conclusion: LA countries adopted partial strategies and operational guidance that may demonstrate a lack of a comprehensive view of research ethics for the review and oversight of COVID-19 research. Continuing efforts should be directed to strengthen LA countries' research capacity to respond timely and ethically to future health emergencies. Past lessons and the ones from this pandemic should be the basis to develop international standards and operational guidelines for ethics review and oversight of any research for public health emergencies.

    A cracked public administration in Peru: How “Vacunagate” has shaken the foundations of an already damaged society

    While crises are ubiquitous in Latin America, due to its geographical characteristics as well as its turbulent business environment, countries such as Peru have also extreme rates of corruption and deep institutional weakness. These factors, taken together, undermine any attempt of national governments or society’s collective efforts towards achieving sustainability. This paper aims to analyze the “Vacunagate” scandal that occurred in Peru during the first negotiations of the vaccination process against COVID-19, using a case study method, and focusing our discussion from the Agency Theory as well as from leadership and institutional perspectives. The results of the analysis emphasize how the “Vacunagate” event generated relevant constraints towards the achievement of the SDG 16, and its specific targets related to provide justice for all, deal with organized crime, reduce corruption, and create accountable institutions. In addition, the study provides insights and implications for organizations in Peru that would have to operate under a turbulent business environment, considering a business-as-usual corruption and a weak institutional context.

    The thrive for a new heritage ethos in Peru?: The Qhapaq Ñan’s policymaking and the ethics of community participation

    This article examines the Qhapaq Ñan Project in Peru and its unprecedented mobilization of heritage policymaking to foster a participatory approach. The World Heritage listing of the Qhapaq Ñan, or Inca road system, catalyzed a new ethos in the Peruvian cultural heritage sector, reflected in a cohesive set of values and practices centered on community participation. This study analyzes the crafting of a participatory approach within Peruvian national heritage regulations despite legal, technical, and ideological constraints, following the rationales and processes that challenged traditional material-centered paradigms. It focuses on how heritage specialists reimagined their ethical commitments in conceptualizing and implementing this framework. It further demonstrates how participatory practices intersect with official regulations and informal practices within pre-existing technical and normative structures, integrating elements such as benefits, consultation, and collaboration. Therefore, the adoption of the Qhapaq Ñan’s participatory approach is argued not merely as a passive compliance with intergovernmental policy recommendations but as an active assertion of ethical perspectives and practices by heritage specialists.

    Educating contemporary performing artists: Research/creation, socio-constructivist learning and psychoanalytic ethics

    The following article explores the relationship between research/creation, the socio-constructivist perspective of learning and psychoanalytic ethics, with the goal of proposing key points for a debate on the education of contemporary performing artists. Considering that it is es-sential to build a space for critical and creative dialogue that facilitates learning from research, the article addresses and problematizes the so-called dogmatic image of art and the teacher/disciple model to approach research/ creation as an educational strategy, which is generator of knowledge and, at the same time, a fertile space for ethical debate around the very limits of scenic practice.

    Este artículo se aproxima a varios de los elementos metodológicos e ideológi­cos presentes en la obra del profesor Gregorio Peces-Barba, relacionándolos con algunas líneas de su pensamiento, a fin de reflejar su contribución e influencia a partir de ciertos contextos. Está especialmente dirigido a los nuevos estudiantes que deseen tener un primer contacto con su pensamien­to. Los temas que se presentan se agrupan en torno al uso de la razón histó­rica, el antropocentrismo secularizado y el discurso sobre las capacidades. También alrededor de la influencia de la Modernidad y la Ilustración, del personalismo comunitario y el socialismo democrático, además de la tradi­ción republicana.

    Una apreciación de la Ética de Spinoza en torno a la libertad como libertad humana

    This article seeks to highlight the relevance of Spinoza’s philosophy with respect to the realization of freedom. His idea of freedom does not deny or reject emotions, and links them to our ability to be rational beings. Spinoza is one of the first philosophers to appreciate an internal dimension of emotions and consider it as part of our own nature, since he affirmed that the human essence is desire itself. The human being is aware of this desire, which drives him to seek ways to affirm his own existence. His notion of freedom must, therefore, consider all these elements to be reflected as something achievable without neglecting what makes us human.

    Bridging the Gap: Returning Genetic Results to Indigenous Communities in Latin America

    In response to inequality in access to genomics research, efforts are underway to include underrepresented minorities, but explicit (and enforcing) guidelines are mostly targeted toward the Global North. In this work, we elaborate on the need to return scientific results to indigenous communities, reporting the actions we have taken in a recent genomic study with Mapuche communities in Chile. Our approach acknowledged the social dynamics perpetuating colonial hierarchies. We framed genetic results to empower indigenous knowledge and communities’ history and identities. A fundamental step in our strategy has been sharing the results with the communities before publishing the scientific paper, which allowed us to incorporate community perspectives. We faced the challenge of translating genetic concepts like admixture, emphasizing the distinction between identity and biology. To reach a broad and diverse audience, we disseminated the study results to single community members, cultural representatives, and high schools, highlighting the importance of the history of the region before the European contact. To facilitate results dissemination, we prepared didactic material and a report in Spanish written in non-specialized language, targeting a wider Latin American readership. This work illustrates the benefits of discussing scientific findings with indigenous communities, demonstrating that a collaborative and culturally sensitive approach fosters knowledge sharing and community empowerment and challenges power dynamics in genetic research. Bridging the gap between academia and indigenous communities promotes equity and inclusion in scientific endeavors.
