La tutela constitucional del inversionista nacional por expropiaciones indirectas(Universidad Femenina del Sagrado Corazón, 2020-12-15)This essay deals with the thesis of the protection of indirect expropriations of national investors, invoking the equal treatment —with the advantages, rights and guarantees of the foreign investor— established in article 63 of the Peruvian Constitution. Our goal is to make explicit the reasons why is it now possible to go forward in the procedural protection of the national investor against cases of indirect expropriation, by using arbitration instead of the amparo process for that purpose. This other procedural protection derives from the Bilateral Investment Treaties and Free Trade Agreements that provides for national or international investment arbitration. Given that this arbitration procedure arises from a legal source, the national investor, under the principle of equality of treatment of the foreign investor is also entitled to use it. - Some of the metrics are blocked by yourconsent settings

Centro de Investigación, Capacitación y Asesoría Jurídica, 2022)La crisis sanitaria por el COVID ha sacudido con fuerza todos los países del mundo. En España se ha materializado en una situación de excepcionalidad constitucional que ha provocado importantes modificaciones jurídicas y ha afectado a todos los ámbitos jurídicos: civil, administrativo, tributario y procesal. No obstante, en ninguna normativa excepcional para estos casos se ha aludido al arbitraje, a pesar de su utilización en el ámbito inmobiliario. El COVID ha impactado también en el arbitraje y ha modificado la forma de realizar el procedimiento: personal trabajando desde casa; envío de comunicaciones telemáticamente; cancelación de audiencias; videoconferencia; etc. La continuidad del arbitraje, frente a los procedimientos judiciales, ha sido como consecuencia de la flexibilidad de que goza el arbitraje como mecanismo de resolución de conflictos privado, adaptándose el procedimiento a las necesidades de las partes. Los distintos organismos españoles dedicados al arbitraje así lo han ido haciendo si bien han chocado, en ocasiones, con la suspensión de los plazos procesales en los casos en que los tribunales españoles actúan como apoyo y control del arbitraje. El colapso judicial que se prevé, una vez terminado el estado de alarma en España, traerá un auge del arbitraje, por su rapidez. - Some of the metrics are blocked by yourconsent settings

Item type:Publication, Who wins in international investment arbitration disputes? Evidence from Latin American and Caribbean countries’ cases under ICSID(Faculty of Economics and Administration, 2021-01-01)During the nineties, an important group of Latin American and Caribbean (LAC) countries adhered to the International Center for Settlement of Investment Disputes (ICSID) as part of a programme of measures that sought to attract foreign investment to the region. With the aim of exploring the determinants of arbitration outcomes, I use a dataset of 161 concluded disputes until 2019 corresponding to investments in LAC countries, finding evidence on the influence of parties’ characteristics, the subject discussed in cases, and characteristics of the tribunal on the arbitration outcomes. I find that 50% of tribunal decisions have been favourable to either claimant investors or host countries. However, this result may be subject to sample bias if information of settlements and discontinued cases is not taken into consideration. I also find evidence in favour of selection and party capability theories that helps to explain the determinants of international investment arbitration dispute outcomes. In particular, the results reveal that disputes related to direct expropriations have a relatively higher probability of being considered founded by tribunals than other legal controversies. Likewise, the indicators of the relative strength of parties, such as experience in the international arbitration system, have an important influence on tribunal awards. Furthermore, country’s time of experience within ICSID is found to have an important influence on the selection of disputes. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, What determines the outcomes of public procurement arbitration?(Taylor & Francis, 2022-11-23)The strengths and weaknesses of arbitration compared to litigation, as a system for solving procurement disputes between governments and their private counterparts has been a subject of debate among scholars. A particularly sensitive topic relates to the impartiality standards of each system and the determinants of its outcomes. Using a unique database of national arbitration resolutions we analyze the determinants of awards in procurement disputes related to public works. Estimating a cross-section model, we find evidence in favor of party capability theory and the influence of institutional factors in arbitration outcomes, like amendments to procurement law or the characteristics of the organization in charge of administering these processes. As well, we find indirect evidence that suggests that adverse outcomes for government entities are related with the lack of individual incentives of officials to settle with private contractors, and the presence of presumably undue influence among private contractors and arbitrators. - Some of the metrics are blocked by yourconsent settings

Se examina el papel de Colombia durante su Presidencia Pro Tempore y se explican las implicancias de la tercera consultoría internacional en dicho proceso. En particular, se detallan algunas de las propuestas presentadas por el Tribunal Andino para la reforma del sistema de solución de controversias de la Comunidad Andina, tales como: el fortalecimiento de la función arbitral, el cobro de derechos de trámite por los servicios judiciales brindados y la constitución de un fideicomiso. - Some of the metrics are blocked by yourconsent settings

In particular, it examines aspects related to procedural rules applicable to arbitration, substantive rules governing the merits of the case, judicialization of claims arising from the total or partial non-approval of additional services, continuity in the performance of contractual obligations, the statute of limitations in arbitration, the binding nature of the arbitral award, and the countersecurity required for interim measures.1 - Some of the metrics are blocked by yourconsent settings
Item type:Publication, ¡Atención árbitros, las cosas están cambiando en el sector construcción!: Building Information Modelling (BIM) como prueba en el arbitraje(Pontificia Universidad Católica del Perú, 2025-12-19)Building Information Modelling (BIM) is essential for orderly project management. Linked to international standardized construction contracts such as NEC (New Engineering Contracts), it contributes to the reduction of execution times and project cost savings, which, in public works, translates into a more efficient management of government resources. By concentrating information that is provided contemporaneously by all parties involved, it will contribute to generate in the arbitrators the conviction they require with a view to reaching material truth, thus contributing to a more solid motivation of the awards. This poses the challenge for arbitrators to become more skilled in the technical and technological aspects of construction disputes, in general, and in the technical evaluation of evidence, in particular.2
