    El consentimiento médico informado de las personas con discapacidad intelectual y psicosocial en el Perú

    Este artigo analisa o problema do consentimento medico informado das pessoas com deficiencia intelectual e psiquica no Peru. Em 2018 Peru modificou o Codigo Civil e reconociou a capacidade juridica das pessoas com deficiencia mental. No entanto, as regras do consentimento informado nao foram modificadas. Nesse sentido, este documento constitui uma primeira tentativa de interpretar o consentimento medico informado no Peru a luz do Codigo Civil. O documento aborda como apoios e salvaguardas podem interagir nesses processos de tomada de decisao.

    The flag of imagination: Peru's new reform on legal capacity for persons with intellectual and psychosocial disabilities and the need for new understandings in private law

    This paper analyzes the recent reform regarding the legal capacity of persons with disabilities in Peru. It provides a domestic legal and judicial context in which the reform was adopted. Following this, the paper aims to analyze the reform's conformity with article 12 of the Convention on the rights of persons with disabilities, noting that the current regulation is only partially CRPD compliant. The current design of judicially designated supporters can be understood as valid under specific interpretations of Article 12, while the design of safeguards does not comply with such standard. The paper addresses the impact of legal capacity reform in traditional private law theory of the juridical act. Currently, the Peruvian system does not provide clear or accurate standards to respond to this problem. The paper shines a light on the need to rethink multiple concepts of private law in order to make legal capacity reform fully operational.

    El Tribunal Constitucional del Perú y la actual aplicación de su función sancionadora en materia disciplinaria: análisis de resoluciones que imponen multas a abogados

    En el Perú, la mala práctica profesional del abogado es pasible de ser sancionada por diferentes órganos del Estado, entre estos, el Tribunal Constitucional. Toda vez que no existe una regulación del procedimiento que los magistrados de dicha corte deban seguir para sancionar a los abogados, el presente texto analiza una serie de resoluciones de este órgano jurisdiccional a través de las cuales se sancionó a dichos profesionales con el fin de hallar puntos comunes. Así, tras reseñar las resoluciones seleccionadas se realiza el análisis mencionado para (i) determinar la base normativa sobre la cual se sanciona a los abogados; (ii) identificar los criterios que este órgano jurisdiccional utiliza actualmente para sancionar las faltas cometidas por dichos profesionales; e, (iii) identificar posibles falencias del procedimiento, entre las que destaca la posible inobservancia de garantías procesales tales como la del non bis in idem. Asimismo, al final del texto se plantean algunas recomendaciones en relación con las falencias halladas.

    La compleja comprensión del artículo 12 de la Convención sobre los Derechos de las Personas con Discapacidad [versión accesible para lectura con JAWS]

    The adoption and implementation of the Convention on the Rights of Persons with Disabilities drastically changed the understanding of the rights of persons with disabilities. The right to legal capacity (or legal agency) of persons with disabilities stands out, among other issues needed for its implementation. The Convention recognizes that persons with disabilities can make decisions and their disability is not ground for denying legal capacity. This goes against what most Civil Codes state in our region. To guarantee said right, it is necessary that States recognize support for legal capacity that are guarded by safeguards. These will prevent abuse, undue influence and conflict of interest. This article presents the different debates that have occurred at the theoretical level regarding these new institutions. Article 12 forces us to rethink several legal terms such as the juridical act and its grounds for voidness and voidability; informed consent or unfitness to plead.

    ¿Manos limpias y corazón puro?: La aplicación de la doctrina de manos limpias por parte de la Corte Interamericana de Derechos Humanos

    Este artículo realiza un análisis de la práctica de la Corte Interamericana de Derechos Humanos (CorteIDH) respecto de la doctrina de “manos limpias” y su legitimidad. El texto argumenta que un enfoque de “manos limpias” para la compensación de daños morales en casos de derechos humanos es inadmisible. Su uso es aún más cuestionable, toda vez que la CorteIDH no ha brindado una explicación respecto de sus decisiones de negar reparaciones por daños morales solo para algunos infractores. El texto revisará casos en los que la CorteIDH ha otorgado y no ha otorgado una compensación monetaria por daños morales con el fin de resaltar su inconsistente jurisprudencia, así como la falta de criterios claros y decisivos. Se concluirá que la CorteIDH ha aplicado la doctrina de “manos limpias” sin manifestarlo explícitamente, y que esto no es compatible con el derecho internacional de los derechos humanos.

    La integridad profesional como parte del deber de ser ejemplo en la abogacía: reflexiones a partir del “Caso Telmo”

    El presente artículo se basa en la denuncia presentada contra la abogada María Paola Carbajal Ponce ante el Consejo de Ética del Colegio de Abogados de Lima, por haber cometido infracciones éticas hacia el practicante a su cargo, Telmo Paz. En específico, se hace referencia al audio en el que se exponen los malos tratos verbales que recibía el practicante por encontrarse inconforme con el trabajo encargado. Al respecto, se plantea como la presentación de la denuncia, admisión a trámite y posterior resolución favorable -importante, aunque aún insuficiente- por parte del Consejo de Ética establecen un precedente sobre cómo se deben abordar las infracciones éticas hacia practicantes. Y a su vez, que los abogados tienen obligaciones más allá de las que se crean con sus clientes o centros de trabajo, las cuales refieren a ser íntegros y ser un ejemplo de profesionales para sus pares, haciendo énfasis en los profesionales en formación. Finalmente, también se desarrolla que el maltrato y la hostilización laboral horizontal hacia practicantes pre y profesionales es sistemático, e incluso forma parte de la cultura e identidad de la idea de la “adecuada” formación profesional en Derecho, en especial, en estudios de abogados. Lo cual, advierte sobre la carencia de una formación con enfoque ético, porque se construye una incuestionable impunidad y lealtad hacia ambientes de hostilización vertical y violencia cuando, lo natural, es el “pagar piso”.

    Street Workers and the Law: A First Impression on Legalized Discrimination in Municipal Ordinances on the Matter in Metropolitan Lima

    Street trade is one of the most common sources of income for people living in poverty in mostly informal economies. Such work exposes them to a series of economic, social and also legal barriers. In the present document, we have analyzed the legal provisions of eight districts of Metropolitan Lima to determine how the norms regulate the work, the use of space, hygiene and the time of street traders in this city. According to our research, the municipal ordinances of Metropolitan Lima point to the street trader as another racialized person who must be controlled in the public space. Although it is not excluded, its inclusion is precarizing, increasing its vulnerability.

    A Four-Speed Reform: A Typology for Legal Capacity Reforms in Latin American Countries

    In the past few years, Latin American countries have started to enact changes in their legal capacity regulations regarding persons with disabilities. However, even when these changes started over eight years ago, there were few to no analyses on the matter. In addition, there is no encompassing theory or typology on how these reforms happen and on their effects. In the present paper, we propose two axes of analysis for the reforms: enforceability and compliance with Article 12 of the CRPD. This matrix allows for four kinds of reforms: incipient, formal, conciliatory and radical. Using this matrix, we examined the legislative changes in Argentina, Brazil, Colombia, Costa Rica, the Dominican Republic, El Salvador, Mexico, Nicaragua and Peru. Incipient reforms (Mexico) are not that effective but can lead to serious later change. Formal reforms (the Dominican Republic, El Salvador and Nicaragua) have few to no effects. Conciliatory reforms (Argentina, Brazil and Costa Rica) are a legislative compromise that allows for progressive change. Finally, radical reforms create encompassing change that is good but might create problems in the implementation.
