Item type:Publication, Medidas correctivas como herramienta alternativa a las sanciones administrativas: una propuesta metodológica(2024-01-01)En el Perú, los organismos reguladores de servicios públicos han adoptado tradicionalmente esquemas de comando y control que priorizan la corrección de incumplimientos normativos mediante sanciones, en lugar de utilizar mecanismos menos invasivos. Esta situación ha generado un deterioro en la relación entre el Estado y las empresas reguladas, así como un contradictorio incremento en el índice de incumplimiento de las obligaciones regulatorias en algunos sectores. En el presente trabajo se analiza la capacidad disuasoria de las medidas correctivas como alternativa a las sanciones, y se propone un marco metodológico predecible para su aplicación. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, The Expiration Regime in the Sanctioning Area of the State Procurement Supervisory Body: An Analysis of the Applicability of Expiration in the Sanctioning Procedure Regulated in the State Procurement Law of Peru(Universidad Nacional del Litoral, 2023-07-01)The objective of this investigation is to analyze the reasons why the State Procurement Supervisory Body (OSCE) excludes expiration from being applied to sanctioning procedures that are conducted in the field of public procurement. For this, the foundations, principles and regulation of the common regime enshrined in the Single Ordered Text of the General Administrative Procedure Law will be reviewed to define whether or not expiration can operate in sanctioning administrative areas regulated by special legislation.Scopus© Citations 1
