Item type:Publication, How the European Citizens’ Initiative ‘Water and Sanitation is a Human Right!’ Changed EU Discourse on Water Services Provision(Utrecht University Library Open Access Journals (Publishing Services), 2020-01-01)In 2010 the United Nations General Assembly recognized the human right to water and sanitation in what is seen as a historical vote by water activists. Implementation of the right to water is imperative to achieve sustainable development. In 2011 the regulation for a European Citizens’ Initiative (ECI) entered into force in the European Union. With such an initiative it is possible to propose an issue for European legislation by collecting one million signatures from citizens in at least seven Member States. The European federation of trade unions in the public services sector (EPSU) decided to take up the challenge to organise such an ECI and formed a diverse coalition of organisations and water activists that became known as ‘Right2Water.’ Their proposal was ‘to implement the human right to water and sanitation in European law.’ Although it was successful in achieving the required number of supporters, the European Commission answered that implementation of the human right to water was to be left to Member States and that there was no need to change existing legislation. The Right2Water movement aimed not as much to change legislation but more to challenge EU neoliberal policies and shift them from a ‘market approach’ to a ‘rights-based approach.’ This chapter looks at the factors that contributed to the success of ‘Right2Water,’ how the ideological debate around the human right to water took place during the campaign and the impact it had on EU discourse as well as on EU water policy. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, El rol de los gobiernos locales en la conservación de los humedales costeros: el caso del sitio Ramsar Los Pantanos de Villa(Científica del Sur University, 2021-01-01)This policy brief analyzes the role of local governments and municipalities with jurisdiction in the Special Regulatory Zone of Pantanos de Villa (ZRE PV) in their participation as members of the Board of Directors of the Municipal Authority of Pantanos de Villa -Prohvilla. In addition, the review and analysis of management documents have been carried out, such as minutes of the Board of Directors, agreements of the Board of Directors, and Annual Reports. The low participation (in terms of attendance, voting, and initiative) of the Board of Directors members has been noticed. Based on what was found, the implementation of a regulation of the Board of Directors is proposed. Through this regulation, the obligations, rights, and other guidelines on the participation of each member are indicated. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Evaluation in Peru(Springer International Publishing, 2022-01-01)Evaluation in Peru has been mainly developed in the last two decades, framed by a favourable Latin American impulse, under an uninterrupted democratic government, favourable economic conditions and fight against corruption. Its evolution was linked to the search for greater efficiency and transparency in development interventions and is characterised by an increase in the use of evaluation in various sectors, the emergence of evaluators’ organisations (such as EvalPerú and REDPERUME), publications and specialised training programmes. In the public administration, the practice of evaluation has been accompanied by reform and modernisation of the state. In the executive branch, it emerged from the Ministry of Economy and Finance and spread to the social sectors. In Civil Society, it has a mainly administrative focus. There is no regulation on the promotion and dissemination of evaluations in civil society. Nor is there any debate between the state and the instituted civil society, which counts on evaluation as an input. Dissemination is voluntary, and its use is unknown. Specialised training has evolved from specific training and development of support materials in monitoring and evaluation, to postgraduate programmes offered by Peruvian and international academic institutions. There is a critical mass of professionals. Although there are important advances, evaluation in Peru has not yet reached its full potential. Important challenges remain, such as the consolidation of advances in the public sector, the assimilation of evaluation in civil society as a public good, and the deepening of professionalisation. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, From access challenges (as data) to methodological insights: Enhancing qualitative inquiries in public administration research(SAGE Publications Inc., 2024-09-01)Little attention has been given to questions of blocked access in public administration research. We draw on past scholarship on access: qualitative research accounts in public administration that address access processes, problems, and possibilities; and our own experience with access challenges in a public school setting involving public sector employees. This allowed us to detail three methodological principles to facilitate the initiation of ethnographic research while access was constantly (re)negotiated: accounting for regulations, rules, and ruling artifacts; meaningful events; and routine and non-routine artifacts. We investigated public administration regulations, events, and artifacts, developing and employing an empirical method to collect data under conditions where access to primary field sites is blocked based on the boundary condition of our investigation. By describing the research findings and their applications, we demonstrate that conceptualizing access problems as multiple data layers can provide researchers with profound insights into relational dynamics, thereby enriching qualitative inquiry in public administration research. We conclude by arguing that this approach remains highly relevant even as field access is constantly negotiated. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, The Policy Making on Venezuelan Migratory Policies in Peru 2017-2022: Processes, Bifurcation Points and Drivers(Universidad Pontificia Comillas de Madrid, 2026-01-01)This study examines Peruvian public policies on Venezuelan migration, identifying factors influencing their formulation and implementation while uncovering their behavioral patterns. Using a qualitative approach based on process tracing and thematic analysis of official documents, media narratives, and statistical data, the research identifies three phases of migration policy: (1) open-door policies, (2) securitization and restriction, and (3) invisibilization and normalization of irregular migration. These phases reveal a disconnect between political rhetoric and practical outcomes, with calculated tolerance for policy non-enforcement and migrant integration delegated to civil society and international organizations. The findings highlight incoherent migration policies marked by legal non-compliance, omission as a strategy, and limited state intervention. These dynamics are driven by advocacy coalitions excluded from decision-making, strained executive-legislative relations, and media-influenced public opinion. The study's originality lies in its innovative combination of process tracing and thematic analysis to explain policy dynamics in contexts of institutional fragility.1 - Some of the metrics are blocked by yourconsent settings

Item type:Publication, El delito de tráfico de influencias en su modalidad real en el Código penal peruano: una crítica a su configuración típica(University of Deusto, 2026-06-24)Desde la doctrina penal se han desarrollado posturas a favor y en contra de incorporar como delito el tráfico de influencias en su modalidad real, debido a que el traficante y el comprador de influencias son particulares ajenos a la Administración, por lo que la conducta del primero no colocaría en peligro a su correcto funcionamiento. En ese contexto, en el trabajo se evalúa la compatibilidad de su estructura típica con la técnica de tipificación de peligro abstracto y con los principios limitadores del ius puniendi estatal, especialmente el de lesividad y el de mínima intervención. El análisis permite concluir que la sanción penal del tráfico de influencias resulta legítima siempre que se reformule el tipo penal y se exija como elemento objetivo la efectiva intercesión del sujeto activo ante el funcionario público. De esta manera, la conducta del traficante es ex ante idónea para crear un riesgo prohibido para el correcto funcionamiento de la Administración, particularmente en lo relativo a su imparcialidad. Item type:Publication, El Delito de Peculado Degrada La Administración Pública en el Ecuador(2025-02-10)El presente artículo, analiza cómo las acciones de los servidores públicos, en relación con el delito de peculado degradan la imagen de la Administración Pública en Ecuador, se aborda al servidor público, su naturaleza jurídica-administrativa, características, así como su rol dentro la administración pública. Asimismo, se profundiza en la ética pública y en las disposiciones legales que establecen las competencias y facultades otorgadas por la Constitución. Examina el abuso del derecho en el que incurren los servidores públicos en relación al delito de Peculado a través de una síntesis histórica del peculado que permite conocer de manera objetiva como este delito se presenta en el Ecuador y, como ha ido afectando la imagen de la administración pública y su tipificación hasta la presente fecha. El objetivo de esta investigación es establecer cómo el peculado degrada la administración pública, para ello se emplearon técnicas de Investigación con enfoque Mixto (Cuantitativas-Cualitativas); el modo Normativo-Jurídico y, como técnicas de investigación, los datos documentales de investigaciones publicadas en cuanto a los valores en la administración pública, para generar un debate y proponer una posible solución que incluya realizar una reforma a la Constitución de la República del Ecuador, a fin de que, el artículo 208 disponga entre sus deberes y atribuciones al Consejo de Participación Ciudadana y Control Social, ser el órgano fiscalizador de las acciones realizadas por la Contraloría General del Estado.2
