    Practice-based evidence: bridging the gap between research and routine clinical practice in diverse settings

    This article is an introduction to this special issue dedicated to promoting the building of bridges between research and clinical practice. The purpose of this compendium is to delve into the relevance and possibilities that the Practice-Based Evidence (PBE) paradigm offers, which includes establishing a two-way dialogue between clinical practice and research, through the studies carried out by researchers from different countries and with different backgrounds, their approaches to the construction of knowledge from the ‘bottom up’ and the application of their findings to routine practice. PBE seeks to develop research whose findings are relevant for practitioners in routine clinical settings, from dissimilar countries and cultural contexts, where the central interest is improving the quality of treatment provided to users of mental health services.

    Governmentality in Evidence? Evolving Rationalities of Forest Governance in Peru

    During the recent decades, the effectiveness, sustainability and equity of environmental and resource policies have become increasingly intertwined in governance reforms. This situation with potentially inherent trade-offs has challenged not only the policy planners and implementers, but also the scientific and expert communities to justify the role of specific forms of scientific knowledge in the pursue of multiple and often conflicting objectives. Evidence is a closure of a particular science-policy interface in which the offered scientific knowledge satisfies institutional decision-making criteria. Therefore, for decision-makers evidence is not only information that is judged useful to make their decisions but also a persuasive tool for them to justify the decisions made through giving reasons. We focus on how different prevailing decision-making and administrative rationalities, governmentalities, have shaped the knowledge base and epistemic requirements of forest governance in Peru. We depict a shift from a forester-dominated to legalistic and neoliberal forest governance structure whose main goal has been to foster the forest economy under an economistic sustainable resource use mentality. Increasingly complex administrative processes to support tracing timber extraction, transport and trade have resulted from the institutional adjustments, but, parallelly, also emerging participatory planning processes have challenged and re-politicized the forest governance structure.

    La deficiente regulación de la inspección judicial en el Código Procesal Civil peruano: Vacíos y propuestas de reforma

    This research article focuses on the legal and normative analysis of judicial inspections in Peru, critically examining their current regulation. The study identifies and discusses the shortcomings and gaps in the legal provisions of the Peruvian Code of Civil Procedure and proposes solutions for future legislation. Structural problems are critically analyzed, particularly the lack of clear normative limits regarding dignity and bodily privacy, the absence of a specific procedure for judicial inspections in collegiate courts, the lack of provisions for the use of new technologies, such as drones, and the inspection of electronic documents. The methodology employs comparative law as a tool to support the need for legislative reform.

    Daño moral in re ipsa: Usando las “máximas de experiencia” como placebo probatorio

    El daño moral ha sido considerado siempre como un daño de difícil probanza, debido a su carácter mental, subjetivo y transitorio. Por ello, para evitar la exigencia de una prueba directa, la doctrina y la jurisprudencia han promovido su tratamiento como un daño in re ipsa, infiriendo su existencia a partir del uso de máximas de experiencia. Las máximas de experiencia, en estas operaciones inferenciales, fungen para conectar la ocurrencia de ciertos hechos conocidos con la existencia desconocida y no probada del sufrimiento emocional constitutivo del daño moral. Sin embargo, desde este trabajo se sostendrá que muchas veces dichas máximas no cumplen con los requisitos epistémicos que justifiquen su aplicación, operando más bien como placebos probatorios “legitiman” las decisiones aparentando corrección, pero no se cumple con lo mínimo requerido para su uso racional.
